اللامشي: نسبة إلى (اللامش) وهي قرية من قرى فرغانةمن بلاد ما وراء النهر، بالقرب من (تركستان). ذكر محقق الكتاب أنه جاء في أحد النسخ الخطية: (من تصنيف الشيخ الإمام الجليل محمود بن زيد اللامشي) وهو ما يجعل النسبة ثابتة إليه؛ لاسيما مع عدم الوقوف على نسبة أخرى للمؤلَف، أو منازعة فيها. لم يشر المؤلف في الكتاب إلى سبب خاص دعاه إلى التأليف، وإنما افتتح المؤلِف الكتاب بالحديث عن موضوعات أصول الفقه مباشرة، كما أنه أثناء عرضه لموضوعات الكتاب لم يشر إلى ما قد يفهم منه وجود سبب خاص للتأليف. والذي يغلب على الظن ـ من خلال الاطلاع على الكتاب وقراءته أكثر من مرة ـ أنه كان تأليفاً مجرداً ولم يكن على شكل دروس ألقيت فجمعت، أو كان إملاء؛ وذلك أخذاً من تسلسل أفكار الكتب وعدم تداخل موضوعاته، وكونه كان على نسق واحد. ومع هذا فقد استوقفتني عبارة أوردها المؤلف الأمر بالشيء لا يكون نهياً عن ضده، والنهي عن الشيء لا يكون أمراً بضده، وهو قول بعض أصحاب الشافعي، كذا ذكر في بعض النسخ، وفي بعضها: ذكر قول المعتزلة وحده). وكنت في الوهلة الأولى أشعر أنها تصرف من محقق الكتاب، حتى راجعت نسخة خطية للمؤلَف ووجدتها في، مما جعل الشك قائماً في كون المؤلَف اختصاراً لأحد الكتب الموجودة في عصره أو ما يقاربه. Abstract: Al-Lamshi: The name is attributed to (Lamsh), a village in the region of Farghana, located in the area of Transoxiana, near (Turkestan).The editor of the book noted that one of the manuscript copies reads: “Authored by the esteemed Imam Sheikh Mahmoud bin Zayd Al-Lamshi,” which confirms the attribution of the work to him, especially in the absence of any other known attributions or disputes regarding authorship. The author did not mention any specific reason that prompted him to write the book; rather, he begins directly with discussions on the topics of Usul al-Fiqh. Throughout the presentation of the topics, there is no indication of a particular reason for composing the book. From repeated readings and thorough study of the text, it appears that the book was independently authored and not a compilation of lectures or dictations. This is inferred from the coherence of the ideas, the logical flow of topics, and the consistent structure throughout the work. However, one phrase used by the author caught my attention: “Commanding something is not considered a prohibition of its opposite, and prohibiting something is not considered a command of its opposite.” This statement, according to some manuscript versions, is attributed to some of the followers of Al-Shafi’i, while in other versions it is attributed solely to the Mu’tazilites. Initially, I suspected that this statement might have been an addition by the editor. However, after reviewing a manuscript copy of the work, I found the statement there as well, which raises the possibility that this book might be an abridgment of another work from the same period or earlier.
